In the interest of recognizing possible patterns in workplace abuse as it relates to fraud and part of the on-going Case Study: Johnson & Johnson Ethicon Acclarent we’ll look at the relationship between executives and lower level employees (accomplices) via The Sociopathic Business Model™.  For potential patients, doctors, or hospitals there are patterns in unethical behavior that can translate to the general public.

At first glance, Patrick (Pat) Fabian currently Chief Commerical Officer at NxThera appears to have an oversight on his LinkedIn profile, prior to Chief Commerical Officer at NxThera Fabian previously worked at:

  • Sonitus Medical
  • Acclarent or Johnson & Johnson’s Ethicon’s Acclarent
  • Accellent

However in the SEO rich Previous box on Fabian’s LinkedIn profile it indicates Sonitus Medical then Accellent with no metion of Acclarent.

This may seem like splitting hairs but again as it relates to The Sociopathic Business Model™ we look to pathological patterns to help us decide if a person in an executive position who represents a company is acting ethically or legally to help us determine if we’d want to purchase from or work for this person and the company they represent.

SEO (search engine optimization) for many is a way to try and control what’s found on the internet as it relates to image via written content.  In many cases, as we’ve seen with other Johnson & Johnson executives, CEO Alex Gorsky and Worldwide President of Ethicon (Surgical) Gary Pruden certain titles related to the company’s blockbuster $2.2 billion fraud case regarding Risperdal were removed from their company bios presumably to distance from previous negative truthful information that could harm their image which is tied to profits and did so without shame, remorse, guilt or accountability.

SEO manipulation to avoid accountability for possible unethical & or illegal behavior coupled with Acclarent’s unofficial & often repeated motto “making small subtle changes to the 510K,” go unnoticed by the FDA as a means to get a medical device approved unethically & illegally quicker reasonably challenges that perhaps Fabian purposely (manipulated facts) left off, omitted or removed Acclarent from the SEO area of his LinkedIn profile.  It’s also reasonable to possibly suspect that Fabian could be trying to control the negative truth that he was federally arrested and indicted on 18 counts of fraud for alleged unethical & illegal behavior when he was an executive at Johnson & Johnson’s Ethicon’s Acclarent.

Phew! What luck that Acclarent and Accellent look so similar and that Patrick (Pat) Fabian could possibly make “small subtle changes” to his LinkedIn profile as a means to distance from previous unethical & or illegal behavior wihtout shame, remorse guilt or accountability for his image which is tied to profits (or in the case of startups also funding) as an executive at NxThera.

Fact based evidence over time is a good indicator of the future. Mr. Fabian’s alleged mugshot via MedTech[y]. Trouble with the law is an indication The Sociopathic Business Model™ is being utilized and the use of Mr. Fabian’s alleged mugshot is not meant to demean or insult but rather demonstrate a pathological fact based history as a means to make educated future decisions.

Mr. Fabian, after & despite his federal arrest, possibly jeopardizing conditions of release on his $500,000 bail, proceeded to hire at least four former Acclarent subordinates: Cauchy Alemzadeh, Brian Johnson, Young Lee & Brent Kelley to again be his subordinates at NxThera.  Not only is this unethically (some would argue illegally-ummm hello DOJ?) a conflict of interest it is demonstrating a clear pattern of manipulating the facts while not recognzing the rights of others (the least of which were former employee accomplices turned employee victims) without shame, remorse, guilt or accountability.

Former Acclarent employees Cauchy Alemzadeh Brian Johnson, Young Lee & Brent Kelley knowingly and willfully chose to again work for Mr. Fabian at NxThera fully aware of alleged illegal behavior and that they may be called to testify against him in federal court on criminal charges.  NxThera knowingly & willfully still employs Patrick (Pat) Fabian despite his arrest where he was indicted on 18 counts of fraud on April 10, 2015 and under The Sociopathic Business Model™ this employer and these employee accomplices chose, based on fact based evidence, to work for someone accused of 18 counts of federal fraud.

When reps/lower level management elect to provide their talents to those who act allegedly unethically & illegally it’s part of the problem and an impediment to creating positive change in the overall industry where unethical & illegal behavior is encouraged, replicated & rewarded.

This is enough information for me to know that as a consultant I would not work with or for Patrick (Pat) Fabian, Cauchy Alemzadeh, Brian Johnson, Young Lee, or Brent Kelley at NxThera or purchase any products from NxThera for ethical reasons nor would I recommend any of my clients work with or purchase any products from Patrick (Pat) Fabian, Cauchy Alemzadeh, Brian Johnson, Young Lee, Brent Kelley, NxThera (or any former Acclarent employees who factually chose to work at NxThera under the direction of Patrick (Pat) Fabian.)

And, if recent announcements from the DOJ getting tougher on Wall Street executives are any indication some choices will be made for us:

The Justice Department(DOJ) often targets companies themselves and turns its eyes toward individuals only after negotiating a corporate settlement. In many cases, that means the offending employees go unpunished.   (In a memo), a copy of which was provided to The New York Times, tells civil and criminal investigators to focus on individual employees from the beginning. In settlement negotiations, companies will not be able to obtain credit for cooperating with the government unless they identify employees and turn over evidence against them, “regardless of their position, status or seniority.” Credit for cooperation can save companies billions of dollars in fines and mean the difference between a civil settlement and a criminal charge.

      Jake Jim. If Melayna Lokosky is crazy and obsessed I say, such a shame that there are not more people of her commitment and courage. She has taken up the cudgel on my behalf. A perfect stranger in a foreign country who simply requested that Melayna consider exposing a US conglomerate that has put profit before patients and ruined my life along with almost a quarter of a million people, men & women, worldwide.

      The little people NEED people like Melayna. There are so few willing to stand up for victims but word is getting out my friend. ABC Australia has launched an expose recently and the Irish & Indian Governments have become involved.

      It is too late for myself and people like me as we have the timebomb of a potential carcinogenic ticking away in our brains and other organs, as well as a much diminished quality of life and long term disability, loss of career, loss of marital function, indeed the list is endless. If you truly realised how these multi billion dollar executives put profit over misery perhaps you would not be so quick to judge, or, maybe you are one of those greedy executives with no remorse. When company lawyers are briefed to term patients and victims as numbers and statistics, to me that to me is crazy & peverse. And I am one seriously obsessed and crazy dude and will remain so until I get justice or die.
