There’s predictability in patterns and fraud has a very clear pattern that’s exposed on this site under the characteristics of The Sociopathic Business Model.  That knowledge coupled with some basic level understanding of website analytics can demonstrate how to track, analyze, and predict the next steps of a company that pathologically acts unethically and or illegally.

I’ve often written that the exposure of the negative truth about Johnson & Johnson and their many subsidiaries has unwittingly made them a very viable poster child for The Sociopathic Business Model™ and with that comes the latest Case Study:

All Accomplices Become Victims

Victims of The Sociopathic Business Model™ include patients, consumers, employees and taxpayers alike. Again there are varying degrees of victimization but no one victim should be discounted. Employee victims (and I was one) are understandably tougher to feel sympathy for as they were complicit (often unknowingly) with crimes on behalf of the company.  A distinguishing factor: was the employee accomplice manipulated through lies to engage in unethical and or illegal activities on behalf of the company or was the employee accomplice actively engaged in creating the lies then used as a manipulation to engage other employee accomplices?

This dynamic is more common than people are willing to admit in the business world as it’s not a trend it is entrenched. Workplace abuse is often dismissed as someone not being “a team player” where employees are made to feel shame, fear or retaliation for reporting the truth.

I have and will continue to maintain that over 90% of fraud starts at the top of the organization.  I’m not the first to state it, nor sadly will I be the last. That remaining 10% is usually an employing looking to gain favor and following the lead of executives and managers who’ve encouraged, replicated and rewarded unethical & illegal behavior.

The story of The Yellow Brick Road again is used to help readers understand a very complex story involving career paths of executives (and is in no way meant to demean or insult the readers or the subjects). The characters in the movie version, were flawed and had redeemable qualities, keep an open mind and decide for yourself if redemption is owed in this version.

Alex Gorsky (Tin Man)- was promoted to CEO & Chairman of Johnson & Johnson Worldwide during the federal investigation of Johnson & Johnson’s Janssen Pharmacutical’s Risperdal.  Alex Gorsky was VP of Marketing promoted to CEO at Janssen Pharmaceuticals where the U.S. Department of Justice fined Johnson & Johnson/Janssen $2.2 billion for off label promotion (31 children died, 1,207 serious harmed, 14 year-old males grew breasts) and illegal kickbacks.  Alex Gorsky was also called to testify in Johnson & Johnson’s Ethicon’s Gynecare trail where a judge found the company to have destroyed evidence in some of the 36,000 cases in federal and state court currently for transvaginal mesh.

Gary Pruden (The Lion)-was promoted to Worldwide Chairman & CEO of Ethicon which changed their name to Global Surgery Group at Johnson & Johnson.  Gary Pruden was a Director of Marketing at Janssen Pharmaceuticals, later named COO of Janssen-Canada worked in conjunction with Alex Gorsky and was also made to testify when Johnson & Johnson’s Ethicon’s Gynecare was found to have destroyed evidence in some of the cases for the pending 36,000 transvaginal mesh cases.

Bridget Ross (Dorothy)-was promoted to Worldwide President of Acclarent a Johnson & Johnson Ethcion company. Bridget Ross was a VP of Sales & Marketing, Janssen and also Worldwide President, Ethicon Women’s Health & Urology (Ethicon/Gynecare is a Division of Johnson & Johnson) where there are again currently 36,000 cases in state and federal court regarding transvaginal mesh.

This certainly lends to the theory that unethical and or illegal behavior is not only encouraged, it’s replicated and rewarded as we look at the Tin Man, Lion and Dorothy’s career with Johnson & Johnson. Back to back billions in federal fines coupled with victims groups getting louder (#CleanUpYourMesh) means Johnson & Johnson may need to make an example of an executive (not just a minion).   And true to form and predicted first a year ago and again several days before official word, does an executive accomplice become a vicitm?

On March 12 and 13th the analytics exposed activity on a story (or two) written over eight months ago.  What do these two stories have in common? Acclarent. The drill down (which I will not show to protect any potential current employees fearful of retaliation) does show a sequence of IP addresses which indicate the same division of a subsidiary or perhaps even desktops in the home office.  I’ll reserve my suspicions as to which group it is, for now.

Dorothy Down Killing My Career

Announced via Acclarent conference* call Bridget Ross decided to resign from her current position. I too was given the option (twice) to decide to resign and I believe my reponse was along the lines of dragging my dead body out of the position because I’d done nothing wrong so they’d have to fire me if they wanted me gone.  And they did– wrongfully terminate me.  Companies count on and feed off of employee fear of having to explain termination and they’ll exploit that to the fullest.  Don’t let them.  Take the hit professionally while forcing accountability back onto the guilty.

My yellow brick road (not unlike many of yours) has not been paved with easy decisions and as my sister often tells my nephews they’re not bad kids they just sometimes make bad choices–I hope that Ms. Ross understands that even if it was her decision to leave she still has the time to start making better choices.

I do not believe I worked for Ms. Ross but I know more than a few former employees are singing “Ding Dong Dorothy is Dead” not to mention for than a few mesh victims who will be happy to see some forced accountability in action. Let’s just hope Ms. Ross wasn’t implanted with any of her Johnson & Johnson Ethicon Gynecare products because getting her now former employer to take accountability, as we’ve all witnessed over the last year, will not be done easily or even fairly.

*I seriously have the best friends-my phone vibrated off the nightstand several times throughout the night letting me know my prediction about Ms. Ross’ departure had come to fruition.  There was mention in jest made of a crystal ball to which I responded: Nope just predictability in patterns of fraud.

**Ms. Ross “resigned” from Acclarent since the company is relocating out of Menlo Park to another location in CA and “accepted” a position with DePuy Synthes-yep that DePuy Synthes ($2.5 billion in fines) that’s headquartered in Raynham, MA-on the other coast.  Yep- that’s inconsistent & contradictory language to action. Why not move (within the same state) with the same company-but maybe it was “decided’ for her?  Next stop-the Island of Misfit Toys? (where Johnson & Johnson sends executives who should be brushing up on their interviewing skills)  It will be interesting to see if Acclarent is sold off (not sure it’s even viable anymore) or dissolved and renamed.  Companies often rename or dissolve to distance from previous crimes.

Predictions confirmed: Former Johnson & Johnson Ethicon companies Acclarent, Mentor, Biosense Webster and Advanced Sterilization Products are being merged together to form a new company CSS, to be headquartered in Irvine, California.  This is usally a good indication since it’s out from under the Ethicon umbrella they’re going to sell this division off.

Johnson & Johnson should have structured the sale of Acclarent to force accountability from the Co-founders Josh Makower and John Chang along with former CEO William M. “Bill” Facteau instead of buying smoke and mirrors based off of false projections (among other things.)  Acclarent sold to Johnson & Johnson’s Ethicon for $785 million but only half of that should have been paid at the time of the sale and the remaining $392.5 million only if the company grew a certain percentage (20-50%) comparable to rep quota growth over the next five years.  Everyone has to have skin in the game or else it becomes a breeding ground for fraud.

Starting to feel badly for Johnson & Johnson for getting hustled by The Gods of Frauds? Don’t-Johnson & Johnson was complicit not only by funding Acclarent as a startup but also got greedy when they thought this “formula” could be replicated and continue to give more money to fund future startups linked to Makower, Chang and Facteau initially under the incubator  ExploraMed: Neotract, MoxiMed, Nevro, and possibly EarLens (funded by 22 unnamed investors-really the SEC allows that?) where Facteau currently sits as Chairman and CEO.

Ms. Ross’ executive track record is now comparable to the  Titanic sinking- outside appearances it looks unsinkable but the company never transitioned from the hypergrowth mode (startup) to sustainable growth and she took on too much water too quickly- so both Ms. Ross and the company were set up to fail from the beginning.  This is again where employee accomplices become victims as they were unrealistically forced to achieve numbers that were based on false projections.  Meaning there was no way the company could ever recover what they paid for Acclarent much less sustainable profit and more stress was put on the reps who were blamed for the “failure to execute,”  and many good people lost their jobs as a result.

I’ve often made the comparison of startup med device to startup tech or med tech (outside of just sexism, racism, and retaliation); and, what we’ve witnessed here with Acclarent is what you’ll see happen very soon with startup tech. Once the companies are purchased (based off of false projections and possible fraud) the employees are the ones left holding all the broken pieces.   Companies like Foursquare and Uber are great examples.

These companies should be profitable and sustainable but are heading down the same road as Acclarent.  Interesting Acclarent, despite its many problems, was profitable prior to the sale and had the expense of manufacturing products subject to FDA regulation.  Foursquare/Swarm and Uber are apps that need real ethical leadership and management and where they should start pulling from the ethical (there are a few of us) from device industry to replace their CEOs before it’s too late.  Because anyone in device who hears how Foursquare/Swarm managed to raise over $162 million since 2009 (where no manufacturing of products or government approval is necessary) just laughs and feels sorry for investors who likely are being shown smoke and mirrors as their CEO burns through their money.

To former Acclarent reps and soon DePuy Synthes reps (since the body bags should start piling up-if fact based evidence over time is any indication of the future) look to tech in management or executive roles if you’re looking for a career change where you can fix problems before these companies even know they are problems.

Disclaimer June 30, 2015: I was informed (but not able to verify) that the owners of the site Medtech[y] are unethical people, unknowingly written about previously on this site, whom I would not work with had their identities been originally known.  I came to know the Medtechy[y] when their name appeared on the back end of the analytics on Killing My Career (which is a tactic many unethical will do to get noticed).  The ethical approach is writing an email & introducing the company with the goals and missions while explaining the need for anonymity. 

The need for anonymity when creating a site that exposes the truth others would rather remain hidden is acceptable if owners are still employed by one of the companies they’re exposing or fear of retaliation; however, it is not acceptable to create a site under a new name to distance from previous unethical behavior.  The Sociopathic Business Model™ maintains all supporters (accomplices) eventually become victims of unethical and or illegal behavior and, while I agree with the fundamentals of the site, can no longer support their efforts until affirmative proof to the contrary is provided. It’s up to each person reading this site to make the best decisions based on all the facts.

  • Guess they need some of their own bandaids. Or maybe a whole lot of their bandaids. Too many years entrenched in their Sociopathic(c) Business model. So very sad for so many ruined lives because of their pattern of racketeering activity.

    If they needed the money so bad, I would have happily given them the measly profit they made off the mesh sling implanted in me that destroyed me physically and financially. (Mt. Sinai paid them less than $250.00 for it.)

    Of course, their consultant doctors might have had to live off their salary instead of those “consulting fees”. And the hospital would not have gotten the operating room fees. And the med mal attorney would not have been paid almost $200,000.00. And on, and on, and on.

    Bridget Ross has not resigned. She has moved onto a different role at DePuySynthes. Acclarent is being relocated to a new facility in Southern California.

          Sounds more like the mistakes of Acclarent and Advanced Sterilization Products are going to be papered over by the massive size of Biosense Webster in the new company called CSS. Remember that Advanced Sterilization Products is still operating under an FDA warning letter, and that 2 executives of that company were fined by the FDA

  • Prison. White collar medical device criminals have no ethics or allegiance to our nation. Fines (cost of doing business) just perpetrate the harm and cost to society.

    Thank you Melayna Lokosky for piecing together the convoluted medical device mafia names, places and business practices with clarity and humor.

    Legitimate & sustainable profit from safe and effective medical devices is the goal. PREVENTABLE harm for profit is criminal and our courts must reflect this.

  • The executives at J&J must have been real estate agents in another life. They must believe location, location, location” translates into “replicate, replicate, replicate”. Not working out so well for them, is it?

    Maybe J&J will develop new business plans for its companies that do not include crimes… fraud, obstruction of justice and killing patients. Those two guys are facing some hefty prison time and stiff fines.

    If it were not engaged in a long standing pattern of racketeering activity, MAYBE it would be believable that J&J did not know these guys were crooks. J&J had to do some due diligence to pay $785 million dollars. So they missed the part Where there was no FDA approval for the device as a drug delivery system? Or they “high fived” them saying, “Oh yeah, we did the same thing with the Prolift mesh kit and the FDA did nothing when the FDA found out we sold it for 3 years before we told them”?

    Sorry how all of this Acclarent stuff has so negatively impacted your life, Melayna. Thanks for fighting for others!!!

    Another way of looking at these leadership consistencies is that JNJ puts people that they trust to be good soldiers in divisions they know are headed for trouble. The leaders then just need to sit out their time and take the heat, knowing they’ll be protected and moved into another well compensated role.
